| Annotation | In the article the main periods of the evolution of Hans Kelsen's (1881-1973) understanding of the concept «basic norm» are presented. The features of the translation of «Pure theory of law» and «basic norm» into Ukrainian are given in the beginning. Further Kelsen's interpretation of «basic norm» in the different periods of his activity is considered, e.g. as «hypothesis», «fiction», «transcendental-logical condition» of the law system. In conclusion the features of function of «basic norm» are pointed out. |
