The research is devoted to the shortcomings of the institute of challenge and selfdisqualification of a judge in commercial legal proceedings. The challenge is examined on the practical side and in conjunction with the practice of the European Court of Human Rights. Attention is focused on the changes proposed by the Draft Commercial Code of Ukraine and generally assessed as positive. It has been suggested the peculiar proposals for further improvement of the institute of challenge.
