Annotation

The relevance of the chosen research topic is due to the formation of a new branch of law “urban planning law” and the search for the subject of legal regulation – urban planning relations, which, unlike traditional branches of law, are complicated and quite differentiated.

The purpose of the article is to clarify the conceptual and legal principles of the essence of urban planning legal relations and the criteria for their classification, which fall under the scope of regulation of a new regulatory body in the system of national law, namely urban planning legislation.

The development of urban planning legislation and work on its codification significantly expand the subject, principles and methods of legal regulation of urban planning relations, which indicates the complexity of the “branch of urban planning law”. After all, the concept of urban planning law in a broad sense finds its subject of regulation, distinguishing relations from forecasting, spatial planning, development, housing policy, digitalization, protection of cultural heritage objects and environmental protection, which constitute the directions of urban planning activity.

It has been established that the difficulty in determining the subject of legal regulation lies, on the one hand, in the uncertainty of the elemental affiliation of urban planning law to the system, its place in the hierarchy of law, and on the other hand, in the failure to accept the fact that the subject of regulation of urban planning law goes beyond the clearly defined duality of the legal system and is within the limits of interaction, interpenetration of state, public and private interests.

It is concluded that, despite the conditional division, urban planning relations are “binary”, since they combine interdependent elements – managerial and economic, it is through the combination of vertical and horizontal relations that subjects achieve the goal – the creation of a full-fledged living environment. It is formulated that urban planning legal relations are relations that arise, exist, change and terminate in the process of sustainable development of territories during the implementation of urban planning activities, which, depending on the areas, have their own specific differentiation: norm-setting; monitoring; planning; architectural; construction; environmental protection; monument protection; energy efficiency; scientific and research.

It is proposed to consider urban planning legal relations through the functional criterion of the urban planning / construction industry, which creates an intersection of public and private law, defining these relations through spatial planning, development, maintenance of buildings and structures, determining the social function of its subjects. And the definition of the features of urban planning activity, taking into account the indivisibility of the categories “urban planning activity” and “construction activity” mediated by the organizational-planning and organizational-economic nature, allowed us to identify criteria for the classification of urban planning relations.
