Annotation

The article addresses the issue of compliance with consumer information rights in the field of e-commerce, particularly through the lens of European experience and possible proposals for Ukraine. With the development of digital technologies and Ukraine’s integration into the European economic space, the relevance of this issue has significantly increased, especially in the context of the ongoing war. Military actions have created additional challenges in ensuring the protection of consumer rights related to personal data processing, transaction cybersecurity, and access to reliable information about goods and services.

 The purpose of the article is to study the mechanism for ensuring consumer information rights in e-commerce based on EU legislation, legal doctrine, and practice, and to formulate specific recommendations for improving Ukrainian legislation in the relevant areas of legal regulation.

 The research results demonstrate that the existing European mechanisms for protecting information rights, such as regulations on data processing and cybersecurity, can be effectively implemented in Ukraine, creating a secure legal environment for digital services. The article also proves the importance of further developing the “E-Consumer” State Web Portal based on the combination of secure design of this public information resource with the observance of consumer information rights in e-commerce by default. For the proper implementation of this proposal, the work outlines specific legal tools that could help facilitate the implementation of the European Union’s experience in addressing this issue.

In the conclusions, the current state of the development of the mechanism for ensuring consumer information rights in e-commerce within the European Union is summarized, the measures taken by Ukraine to implement the European experience in this area of legal regulation are characterized, and further directions for adapting Ukrainian national legislation on these issues are identified. This publication was prepared within the framework of the Nominal scholarships of the Verkhovna Rada of Ukraine for young scientists-doctors of sciences in 2024.
