| Annotation | This article examines the specific features of legal framework governing public and defense procurement in Ukraine during martial law, as well as potential directions for its improvement during the country’s post-war economic recovery. Key factors influencing the current dynamics of legal regulation in this area include, on the one hand, the ongoing full-scale military aggression against Ukraine and, on the other, the initiation of negotiations for Ukraine’s accession to the EU. The implementation of martial law has led to an increased reliance on subordinate legislation in public and defense procurement, a stronger focus on security aspects, and the simplification of certain legislatively established procurement procedures and formalities. At the same time, Ukraine continues to align its national procurement legislation with EU law. Some of the EU legal tools and practices already adopted in Ukraine include framework agreements, electronic catalogs, localization, abnormally low bids, lifecycle costing, and more. The development of legal regulation for public and defense procurement in the post-war period will evolve in two dimentions: conceptual and operational. On the conceptual side, regulation must revert to the framework of the laws “On Public Procurement” and “On Defense Procurement,” which will need amendments aimed at simplifying the organization and execution of certain procurement procedures, updating procurement thresholds, improving the appeals process during procurement, and conducting procurement procedures in situations of potential emergencies, among other issues. The draft of the new version of the “Law on Public Procurement”, designed to facilitate effective public procurement in a transparent and competitive manner—including addressing the needs of Ukraine’s post-war recovery—and to fulfill Ukraine’s international legal obligations in the field of public procurement, is analyzed. The operational dimension involves strengthening and institutionalizing instruments such as digitalization (including new services and integration in Prozorro), the use of artificial intelligence, dynamic procurement systems, joint (coordinated) procurement, and socially inclusive procurement. The article concludes that Ukraine has significant potential to align its procurement system with leading European and global standards. The proposed innovative approaches provide a framework for rethinking the role of procurement in the country’s economic modernization and support Ukraine’s integration into global economic and legal processes. Special attention should be given to the potential role of public and defense procurement in Ukraine’s post-war recovery and in securing the country’s long-term sustainable development. |
