Annotation

An important direction of the current stage of Ukraine’s development is its European integration, which determines the European integration trend of the development of modern Ukrainian constitutionalism, an important condition of which is the implementation of the fundamental values of the EU into domestic constitutional and legal realities.

The purpose of the article is a scientific and doctrinal analysis of the synergy of constitutional and legal freedom as the goal of modern Ukrainian constitutionalism and the fundamental values of the EU.

It is determined that the synergy of constitutional and legal freedom of a person as the goal of Ukrainian constitutionalism and the fundamental values of the EU is expressed in the fact that a person occupies a leading place in the doctrine of constitutionalism and the European integration practice of Ukraine, namely: it is the main value reference point of the European integration development of Ukraine, an indicator of verification of the reality and effectiveness of the implementation of the fundamental values of the EU into domestic constitutional and legal realities; and the recognition, provision and protection of constitutional and legal freedom is the goal of the functioning of the system of constitutionalism.

It is argued that constitutional and legal freedom is a concept that dialectically combines such fundamental values of the EU as freedom, equality, justice, respect for human rights through the unity of their human-centered essence.

This provides grounds to consider constitutional and legal human freedom as the goal of the European integration trend of modern Ukrainian constitutionalism.

The author concludes that constitutional and legal freedom of a person as the goal of the European integration trend of modern Ukrainian constitutionalism is the legal (constitutional and legal) and factual state of a person in society and the state, according to which a person is physically, economically, politically, spiritually independent (free) from any illegal (unconstitutional) restrictions and interference in all spheres of individual freedom by public authorities and other social subjects. In order to ensure a balance of interests in the system of relations “man-societystate”, constitutional and legal freedom may be limited in extraordinary conditions (for example, during martial law), but subject to such criteria as temporaryness, constitutionality, necessity, reasonableness (proportionality and sufficiency), justice, immutability of the principles of the constitutional status of a person and his fundamental rights and freedoms defined in the Basic Law of the state.

It is summarized that the modern concept of human rights and freedoms and the system of current constitutional legislation should be aimed at ensuring and establishing constitutional and legal freedom as the goal of the European integration trend of modern Ukrainian constitutionalism.
