Annotation

The article presents a comprehensive legal analysis of the challenges and prospects for the implementation of agrivoltaics in Ukraine as an innovative model of sustainable development in the agricultural sector and a tool for fulfilling the state’s international obligations in the field of climate policy. Agrivoltaics, which involves the combined use of agricultural land for farming and the generation of electricity from renewable sources, is examined in the context of the requirements of the Paris Climate Agreement, the European Green Deal, and Ukraine’s land, agricultural, urban planning, environmental, and climate legislation. The study identifies significant legal barriers that hinder the implementation of agrivoltaic projects within the existing model of land law. Therelevant provisions of the Law of Ukraine “On the Fundamentals of State Climate Policy” and the state’s strategic documents on combating climate change have been studied, highlighting the lack of systematic integration of agrivoltaics into climate policy. The advanced legal experience of regulating agrivoltaics in selected European countries, where agrivoltaic systems are recognized as important instruments for achieving climate goals and transforming the agricultural sector, has been examined.

Based on the conducted research, the necessity of developing a coherent legal doctrine of agrivoltaics in Ukraine and integrating the relevant regulation into the system of energy, environmental, and agricultural law has been substantiated. Directions for improving the legal regulation of agrivoltaic activities have been proposed, which will ensure legal certainty, predictability, and the effective development of this promising field. The need for an interdisciplinary approach and institutional state support is emphasized to fully realize the potential of agrivoltaics in achieving Ukraine’s climate and energy objectives.
